1. Agreement to Terms

Welcome to Gramms! These Terms of Service ("Terms") govern your use of the Gramms mobile application ("App") operated by SmartCue, Inc. ("Company," "we," "our," or "us"), a Delaware corporation located at 651 N Broad St, Ste 201, Middletown DE 19709.

By creating an account or using Gramms, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Gramms is designed for parents and guardians ("you") to create personalized bedtime stories for children ages 3-10. By using this App, you confirm that you are at least 18 years old and are the parent or legal guardian of any child whose information you provide.

2. Description of Service

Gramms provides an AI-powered bedtime story generation service that:

• Creates personalized stories featuring your child as the main character
• Generates expressive audio narration with a warm, grandparent-like voice
• Produces unique cover illustrations for each story
• Stores your story library for repeated playback

Stories are generated using artificial intelligence (OpenAI) based on the information you provide. Each story is unique and created specifically for your child.

3. Account Registration

To use Gramms, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities under your account
• Not share your account or let others access it

You may sign up using email/password or Apple Sign-In. We may suspend or terminate accounts that violate these Terms.

4. Child Profiles & Parental Consent

Gramms collects information about children to personalize stories. As required by the Children's Online Privacy Protection Act (COPPA), we obtain verifiable parental consent before collecting any child's information.

By creating a child profile, you represent and warrant that:

• You are the parent or legal guardian of the child
• You consent to the collection of your child's information as described in our Privacy Policy
• The information you provide about your child is accurate
• You understand how your child's information will be used to generate stories

You may review, modify, or delete your child's profile at any time through the App. Deleting a child profile will permanently remove all associated stories.

5. Story Generation & Usage Limits

Free accounts receive a limited number of story generations per week ("Story Credits"). Your current limit is 3 stories per week, which resets every 7 days from your last reset.

Story generation typically takes 60-90 seconds. During generation, we:

• Generate original story text based on your premise
• Create expressive audio narration
• Generate a unique cover illustration

If story generation fails due to a technical error, your Story Credit will be automatically refunded.

6. Content Guidelines

When providing story premises, you agree NOT to request content that:

• Is violent, scary, or inappropriate for children
• Contains hate speech, harassment, or discrimination
• Includes sexual or adult themes
• References copyrighted characters without authorization
• Promotes illegal activities or self-harm
• Contains personal information about real people (other than your child)

We use content moderation to filter inappropriate requests. Repeatedly attempting to generate inappropriate content may result in account suspension.

7. Intellectual Property

Your Content

You retain ownership of the story premises you provide. By submitting a premise, you grant us a license to use it solely for generating your story.

Generated Stories

Stories, audio, and images generated by Gramms are provided for your personal, non-commercial use. You may:

• Play stories for your child and family
• Share stories privately with family members
• Keep stories in your personal library

You may NOT:

• Sell or commercially distribute generated content
• Use stories in commercial products or services
• Claim exclusive copyright over AI-generated content
• Remove or alter any attribution or metadata

Our Content

The Gramms name, logo, app design, and underlying technology are owned by SmartCue, Inc. and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the App.

8. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

We comply with the Children's Online Privacy Protection Act (COPPA) and the FTC's 2025 amendments. We do not collect more information than necessary, never sell children's data, and provide you with full control over your child's information.

9. Disclaimers & Limitations

Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. Story generation depends on third-party AI services that may experience outages.

AI-Generated Content

Stories are generated by AI and may occasionally produce unexpected results. While we implement content safety measures, we cannot guarantee that all generated content will be perfectly appropriate. Parents should preview stories before sharing with children if they have concerns.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTCUE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

You may delete your account at any time by contacting us at support@getsmartcue.com. Upon deletion:

• All your data, including child profiles and stories, will be permanently deleted
• Any unused Story Credits will be forfeited
• This action cannot be undone

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or attempt to misuse the service.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of these Terms
• Sending you an in-app notification or email for significant changes
• Requiring you to accept new terms before continuing to use the App

Your continued use of Gramms after changes constitutes acceptance of the updated Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
