1. Agreement to Terms

Welcome to Gramms! These Terms of Service ("Terms") govern your use of the Gramms mobile application ("App") operated by SmartCue, Inc. ("Company," "we," "our," or "us"), a Delaware corporation located at 651 N Broad St, Ste 201, Middletown DE 19709.

By creating an account or using Gramms, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Gramms is designed for parents and guardians ("you") to create personalized bedtime stories for children ages 3-10. By using this App, you confirm that you are at least 18 years old and are the parent or legal guardian of any child whose information you provide.

2. Description of Service

Gramms provides an AI-powered bedtime story generation service that:

• Creates personalized stories featuring your child as the main character
• Generates expressive audio narration with a warm, grandparent-like voice
• Produces unique cover illustrations for each story
• Stores the stories you've made so you can play them again

Stories are generated using artificial intelligence (OpenAI) based on the information you provide. Each story is unique and created specifically for your child.

3. Account Registration

To use Gramms you must have an account. Accounts are created with Sign in with Apple; there is no Gramms password, and we never see your Apple ID credentials. You may use Apple's "Hide My Email" option; Gramms works the same either way.

You agree to:

• Keep your Apple ID secure
• Accept responsibility for all activities under your account
• Not share your account or let others access it

We may suspend or terminate accounts that violate these Terms.

4. Child Profiles & Parental Consent

Gramms collects information about children to personalize stories. As required by the Children's Online Privacy Protection Act (COPPA), we obtain verifiable parental consent before collecting any child's information.

By creating a child profile, you represent and warrant that:

• You are the parent or legal guardian of the child
• You consent to the collection of your child's information as described in our Privacy Policy
• The information you provide about your child is accurate
• You understand how your child's information will be used to generate stories

You may review your child's profile at any time in the App. To remove everything at once, close your account in the App (Settings → Close your account), which deletes the profile and every story with it. To remove only part of it, write to robin@gramms.ai and we will do it for you.

5. Story Generation

When you ask for a story, Gramms:

• Writes original story text from the idea you give it
• Reads it aloud in the app's narrator voice, or in a family voice you have added
• Paints a cover picture
• Works out the word timings so the text can be followed along as it is read

Generation usually takes about a minute. If it fails, or if a story is set aside by our safety checks, nothing is charged for it and a ready-made story is offered instead so bedtime is never left empty.

Without a subscription, a household can make three new stories in any seven-day window. Stories you have already made stay in your library and can be read as often as you like, with no limit. A subscription lifts the three-story limit.

6. Subscriptions, Pricing & Billing

Gramms offers an optional auto-renewing subscription, Gramms Premium. It does two things: it lifts the three-new-stories-per-week limit described above, and it unlocks family voices: bringing a loved one's voice into Gramms and having stories read aloud in it. Your first story in a family voice is free, before any subscription. Subscriptions are sold through Apple's In-App Purchase and billed to your Apple Account.

The terms of the subscription:

• Prices are in US dollars. In other countries Apple charges the equivalent local price shown to you in the App Store before you confirm.
• Payment is taken by Apple when you confirm the purchase, or at the end of the free trial.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal is charged to your Apple Account within 24 hours before the end of the current period, at the price for the plan you are on.
• If you start a free trial and then subscribe, the trial's unused portion is forfeited, as Apple requires.
• Manage or cancel your subscription in your Apple Account settings: App Store → your name → Subscriptions. We cannot cancel it for you.
• Deleting your Gramms account does not cancel the subscription. Cancel it with Apple as well, or billing continues.

Refunds are handled by Apple under the terms of the Apple Media Services agreement; we cannot issue them. If we change a price, Apple will ask you to agree to the new price before it takes effect. Your library, playback, read-along and family-voice recordings you have already made remain available whether or not you subscribe.

7. Family Voices

Gramms can read stories in the voice of someone your child loves, made from a short recording of that person reading aloud. This is optional, and nothing about it happens unless you choose it.

By adding a voice, you represent and warrant that:

• The person recorded is an adult who knows what the recording is for and has agreed to it
• You are that person, or you have their permission to provide the recording
• You are not providing the voice of a child, of a public figure, or of anyone who has not agreed

Every recording is checked automatically before a voice is made, and we will decline one that does not pass. A voice is used only to read your family's stories inside Gramms. You may remove it at any time in the app; when you do, the voice is destroyed at our voice partner and the destruction is confirmed before we consider it done. If the person recorded asks us to remove their voice, write to robin@gramms.ai and we will remove it, whoever's account it sits in.

8. Content Guidelines

When providing story premises, you agree NOT to request content that:

• Is violent, scary, or inappropriate for children
• Contains hate speech, harassment, or discrimination
• Includes sexual or adult themes
• References copyrighted characters without authorization
• Promotes illegal activities or self-harm
• Contains personal information about real people (other than your child)

We use content moderation to filter inappropriate requests. Repeatedly attempting to generate inappropriate content may result in account suspension.

9. Intellectual Property

Your Content

You retain ownership of the story premises you provide. By submitting a premise, you grant us a license to use it solely for generating your story.

Generated Stories

Stories, audio, and images generated by Gramms are provided for your personal, non-commercial use. You may:

• Play stories for your child and family
• Share stories privately with family members
• Keep stories in your personal library

You may NOT:

• Sell or commercially distribute generated content
• Use stories in commercial products or services
• Claim exclusive copyright over AI-generated content
• Remove or alter any attribution or metadata

Our Content

The Gramms name, logo, app design, and underlying technology are owned by SmartCue, Inc. and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the App.

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

We comply with the Children's Online Privacy Protection Act (COPPA) and the FTC's 2025 amendments. We do not collect more information than necessary, never sell children's data, and provide you with full control over your child's information.

11. Disclaimers & Limitations

Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. Story generation depends on third-party AI services that may experience outages.

AI-Generated Content

Stories are generated by AI and may occasionally produce unexpected results. While we implement content safety measures, we cannot guarantee that all generated content will be perfectly appropriate. Parents should preview stories before sharing with children if they have concerns.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTCUE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

You may close your account at any time from inside the App: Settings → Close your account. Upon deletion:

• Any family voice is destroyed at our voice partner, and the destruction is confirmed
• Your child profiles, stories and account are permanently deleted
• The audio and picture files those stories pointed at are removed in the clean-up described in our Privacy Policy
• An active subscription is not cancelled; cancel it in your Apple Account settings
• This action cannot be undone

If you cannot open the App, write to robin@gramms.ai from the email address on your account and we will complete the deletion for you.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or attempt to misuse the service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of these Terms
• Sending you an in-app notification or email for significant changes
• Requiring you to accept new terms before continuing to use the App

Your continued use of Gramms after changes constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
